The Court of Justice uses certain criteria to qualify for compensation rights: a delay of 3 hours or more, the origin and destination of the flight, and the nationality of the airline. The amount of compensation depends on the distance between the two airports of your flight and the duration of the delay, which constitutes the harm. It ranges from 250 euros to 600 euros per passenger.

Summary of the compensation amount

  • For a distance of less than 1500 km, you cannot claim a refund if the delay is under 3 hours. However, if the delay exceeds 3 hours, you are entitled to 250 euros in compensation.
  • If the distance is between 1500 and 3500 km, you are only entitled to compensation for a delay of more than 3 hours. The amount is set at 400 euros.
  • For a distance of more than 3500 km, you are entitled to 600 euros in compensation for a delay of more than 34 hours. If the delay does not exceed 3 hours, no compensation is provided.

Furthermore, if you were informed of the cancellation of your flight 14 days in advance, there will be no compensation. This is especially true if the airline offered you an alternative on the same route, with a schedule similar to the original one.
